A 50-year-old man was admitted to a hospital critical care unit with congestive heart failure, atrial fibrillation, bilateral edema, and shortness of breath. While there, he got out of bed to use the bathroom, fell, and suffered severe head injuries, a traumatic brain injury, and a stroke. These injuries caused his death 18 days later, with $145,104 in medical expenses. He was survived by his mother and two sisters.
The lawsuit alleged that the hospital failed to implement adequate fall-prevention procedures. The parties agreed to non-binding mediation, and John H. Stroger Hospital and Cook County Health paid the settlement.
